2TDK has neither approved nor signed the request or addendum for the payment of 360 million euros in additional costs; the Second Track project remains within the financial framework defined in the Amended Investment Program (NIP2).
2TDK is aware of a proposal for addendum, a request addressed to the DRI supervising engineer by the construction contractor consortium. The request is titled “Suspension of Work on Section 1 Due to Delays in the Construction of the Glinščica Viaduct,” in which the construction contractor is requesting additional payment to cover all costs incurred in connection with the suspension of work. The claim relates to the period of work execution in the Glinščica Valley in 2021. The value of the claim amounts to EUR 350,025,600.00.
All claims are handled in such a way that contractors submit claims to the supervising engineer for the recognition of unforeseen work and for the recognition of additional work. The validity of claims in accordance with the FIDIC Conditions of Construction Contracts is reviewed by an independent external supervising engineer. This engineer determines whether there is evidence that the contractor is entitled to any costs or not, or whether the claim is justified or unjustified.
Notwithstanding the above, 2TDK assesses that the amount of the claim is unreasonable given the circumstances known to us. 2TDK handles public funds with care and firmly emphasizes that it has not and will never pay unjustified or unfounded costs.
